RE: EXTENSION OF SERVICE AFTER THE MANDATORY RETIREMENT AGE IN THE PUBLIC SERVICE
Reference is made to Circular Ref.No.OP.CAB 2/7A dated 20th March 2009 that reviewed the mandatory retirement of 55 years to 60 years with effect from 1st April 2009.
This was further reviewed by the Circular issued by Public Service Commission Ref.No.PSC/ADM/13(7) dated 19th November 2020.
However, it has come to the attention of the Ministry responsible for Public Service that Public Officers who have attained the mandatory age as provided under the Public Service Commission Act are making numerous appeals to the Commission for unjustified extension.
Section 80(1) (a) and (b) of the Public Service Commission Act 2017 provides that a Public Officer shall retire from the service with effect from the date of attaining the mandatory retirement age.
The Commission or any other appointing authority shall not extend the service of such retired Public Officers beyond the mandatory age of 60 years and sixty-five (65) years for persons with disability.
The purpose of this letter is to request that all extension review cases be suspended and any existing eases be revoked to enable proper legislations and succession management guidelines be implemented across the Public Service.
